Scope<\/h2>\n    <p>These General Terms and Conditions apply to contracts for the short-term provision of holiday apartments, holiday homes and other holiday accommodation for accommodation purposes in which <b>Andrea Keri e.U., trading under the brand L\u00e4ndlefee<\/b>, is the guest's contracting party.<\/p>\n    <p>The respective booked accommodation, travel period, total price and other property-specific conditions are set out in the respective offer, the booking page and the booking confirmation.<\/p>\n    <p>Deviating or supplementary agreements only apply if they have been expressly agreed between L\u00e4ndlefee and the guest.<\/p>\n    <p>For bookings via external booking platforms, the terms of the respective booking platform may also apply. Where these terms conflict with an individually agreed booking condition, the individually agreed provision takes precedence.<\/p>\n\n    <h2 id=\"vertrag\">2. Contracting party &amp; conclusion of contract<\/h2>\n    <p>The guest's contracting party is Andrea Keri e.U., trading under the brand L\u00e4ndlefee.<\/p>\n    <p>The presentation of an accommodation on a website or booking platform does not constitute a binding contractual offer unless expressly identified as such.<\/p>\n    <p>The accommodation or rental contract is concluded as soon as the booking has been confirmed by L\u00e4ndlefee or the guest receives a binding booking confirmation via an online booking system used.<\/p>\n    <p>For online bookings, the guest receives a booking confirmation at the email address provided after completing the booking.<\/p>\n    <p>The guest is obliged to check the details in the booking confirmation without delay and to report any errors or discrepancies as soon as possible.<\/p>\n\n    <h2 id=\"preise\">3. Prices &amp; payment terms<\/h2>\n    <p>The prices shown at the time of booking apply.<\/p>\n    <p>The total price and the costs included in it, as well as any additional costs, are shown to the guest before the booking is completed.<\/p>\n    <p>Additional costs may be charged in particular for final cleaning, local tax or guest tax, laundry or additional services, agreed additional persons, pets \u2013 where permitted \u2013 or other expressly booked additional services.<\/p>\n    <p>The costs actually incurred are set out in the respective property description and booking confirmation.<\/p>\n\n    <div class=\"hinweis\">\n      <b>Standard payment rule:<\/b> Unless otherwise stated at the time of booking, 30 % of the total price is due after the booking is completed. The balance, including agreed additional charges and any security deposit, must be paid no later than 14 days before arrival. If the booking is made less than 14 days before arrival, the full amount due must be paid immediately.\n    <\/div>\n\n    <p>Payments can be made using the payment methods offered during the booking process. For direct bookings, payment may be processed in particular via Stripe.<\/p>\n    <p>The payment deadlines stated at the time of booking are binding. If a payment due is not made despite a reasonable grace period, L\u00e4ndlefee is entitled to withdraw from the contract in accordance with the statutory provisions.<\/p>\n    <p>Claims that have already arisen, in particular as a result of an effective cancellation, remain unaffected.<\/p>\n\n    <h2 id=\"anreise\">4. Arrival and departure<\/h2>\n    <p>The applicable check-in and check-out times are communicated in the property description, the booking confirmation or the guest information sent before arrival.<\/p>\n    <p>Earlier arrival or later departure is only possible by prior express agreement.<\/p>\n    <p>If self check-in is provided for the accommodation, the guest receives the necessary access information in good time before arrival.<\/p>\n    <p>Access details can only be sent once the payments due for the stay have been made in full and the information required for check-in or the legally required registration data have been submitted in full.<\/p>\n    <p>The guest is obliged to keep access codes, keys or other means of access safe and not to pass them on to unauthorised third parties.<\/p>\n\n    <h2 id=\"minderjaehrige\">5. Minors<\/h2>\n    <p>Concluding an accommodation or rental contract requires the necessary legal capacity.<\/p>\n    <p>Minor guests may generally only use an accommodation together with an adult person with supervisory responsibility or who is duly authorised, unless expressly agreed otherwise.<\/p>\n\n    <h2 id=\"nutzung\">6. Use of the accommodation<\/h2>\n    <p>The accommodation may only be used by the number of persons stated or agreed at the time of booking.<\/p>\n    <p>Occupancy by additional persons requires the prior consent of L\u00e4ndlefee.<\/p>\n    <p>Subletting or any other transfer of the accommodation to third parties, whether for payment or free of charge, is not permitted without express consent.<\/p>\n    <p>The accommodation may be used exclusively for private accommodation purposes.<\/p>\n    <p>Events, parties, commercial use, photo or film productions or comparable uses are only permitted with express prior consent.<\/p>\n    <p>The guest undertakes to treat the accommodation, its furnishings and any shared areas with care and to comply with the applicable house rules.<\/p>\n\n    <h2 id=\"hausordnung\">7. House rules<\/h2>\n    <p>Supplementary house rules may apply to individual accommodations.<\/p>\n    <p>The house rules are made available to the guest before or at the latest at the start of the stay.<\/p>\n    <p>The guest is responsible for ensuring that fellow travellers and visitors also comply with the house rules.<\/p>\n    <p>In particular, the applicable rules on quiet hours, smoking, pets, waste disposal, parking and the use of shared areas must be observed.<\/p>\n    <p>In the event of serious or repeated breaches of the house rules, L\u00e4ndlefee may terminate the contract early after an unsuccessful warning or, in the case of serious breaches, in accordance with the statutory provisions.<\/p>\n\n    <h2 id=\"haustiere\">8. Pets<\/h2>\n    <p>Pets are only permitted if this is expressly stated for the respective accommodation or has been agreed in advance.<\/p>\n    <p>Bringing an unregistered pet may be refused.<\/p>\n    <p>The guest is liable in accordance with the statutory provisions for damage caused by an animal they bring.<\/p>\n\n    <h2 id=\"schaeden\">9. Damage &amp; duty of care<\/h2>\n    <p>The guest must treat the accommodation and its inventory with care.<\/p>\n    <p>Damage or defects already found on arrival should be reported to L\u00e4ndlefee as soon as possible.<\/p>\n    <p>If the guest or a fellow traveller attributable to the guest culpably causes damage, the guest is liable in accordance with the statutory provisions.<\/p>\n    <p>Damage must be reported to L\u00e4ndlefee without delay.<\/p>\n    <p>An obligation to pay compensation only exists to the extent provided for by law. Normal wear and tear or age-related deterioration are not considered damage to be compensated by the guest.<\/p>\n\n    <h2 id=\"kaution\">10. Security deposit<\/h2>\n    <p>A security deposit may be agreed for individual accommodations.<\/p>\n    <p>Whether and in what amount a security deposit is to be paid is set out in the respective offer or booking confirmation.<\/p>\n    <p>The security deposit may serve in particular to secure justified claims for damage caused by the guest, loss of keys or means of access, or other contractual claims.<\/p>\n    <p>Provided there are no justified claims, a security deposit actually collected is refunded within a reasonable period after the end of the stay.<\/p>\n\n    <h2 id=\"storno\">11. Cancellation by the guest<\/h2>\n    <p>The guest may withdraw from the booking at any time before the start of the stay. The time of cancellation is determined by the receipt of the cancellation by L\u00e4ndlefee.<\/p>\n    <p>Unless different cancellation conditions were expressly agreed at the time of booking, the following cancellation fees apply:<\/p>\n    <ul class=\"liste\">\n      <li><b>up to 30 days before arrival:<\/b> free cancellation<\/li>\n      <li><b>29 to 14 days before arrival:<\/b> 50 % of the agreed accommodation price<\/li>\n      <li><b>13 to 7 days before arrival:<\/b> 70 % of the agreed accommodation price<\/li>\n      <li><b>from 6 days before arrival or in case of no-show:<\/b> 90 % of the agreed accommodation price<\/li>\n    <\/ul>\n    <p>Additional services that are not usage-dependent or have already been incurred may also be taken into account in accordance with the statutory provisions.<\/p>\n    <p>L\u00e4ndlefee must credit saved expenses and benefits from re-letting to the extent required by law.<\/p>\n    <p>The guest remains entitled to prove that no loss or a significantly lower loss has been incurred.<\/p>\n    <p>For bookings made via external booking platforms, the cancellation conditions expressly shown there at the time of booking take precedence.<\/p>\n\n    <h2 id=\"widerruf\">12. No statutory 14-day right of withdrawal for accommodation on fixed dates<\/h2>\n    <p>Pursuant to \u00a7 18 (1) no. 10 of the Austrian Distance and Off-Premises Contracts Act (FAGG), there is no statutory 14-day right of withdrawal for distance contracts for accommodation services for purposes other than residential purposes if a specific date or period has been agreed for performance of the contract.<\/p>\n    <p>A holiday accommodation booked with binding effect can therefore not be cancelled free of charge within 14 days merely because the booking was made online, by telephone or by email.<\/p>\n    <p>Instead, the cancellation conditions agreed at the time of booking apply to a cancellation.<\/p>\n\n    <h2 id=\"nichtanreise\">13. No-show, late arrival &amp; early departure<\/h2>\n    <p>If the guest does not arrive without prior cancellation, the agreed cancellation conditions apply.<\/p>\n    <p>In the event of late arrival or early departure, there is generally no entitlement to a pro rata refund for unused nights, unless mandatory law provides otherwise or something else has been expressly agreed.<\/p>\n    <p>Late arrival should be reported to L\u00e4ndlefee as early as possible.<\/p>\n\n    <h2 id=\"ausfall\">14. Changes &amp; unavailability of the accommodation<\/h2>\n    <p>Should the booked accommodation not be available for a reason that L\u00e4ndlefee could not avoid, L\u00e4ndlefee will inform the guest without delay.<\/p>\n    <p>Where possible, the guest may be offered suitable alternative accommodation. The guest is not obliged to accept alternative accommodation.<\/p>\n    <p>If the booked accommodation cannot be provided and no alternative accepted by the guest is offered, payments already made for services not rendered will be refunded.<\/p>\n    <p>Further statutory claims of the guest remain unaffected.<\/p>\n\n    <h2 id=\"maengel\">15. Defects during the stay<\/h2>\n    <p>The guest is asked to report any defects arising during the stay as soon as possible so that they can be remedied.<\/p>\n    <p>L\u00e4ndlefee will remedy justified defects, or have them remedied, as quickly as reasonably possible.<\/p>\n    <p>Statutory warranty and damages claims remain unaffected.<\/p>\n\n    <h2 id=\"stoerungen\">16. Technical disruptions &amp; force majeure<\/h2>\n    <p>Temporary impairments due to circumstances outside L\u00e4ndlefee's direct sphere of influence \u2013 such as short-term disruptions of public utility networks or internet or telecommunications outages \u2013 only give rise to claims where this is provided for by the statutory provisions.<\/p>\n    <p>This does not apply to circumstances for which L\u00e4ndlefee is responsible.<\/p>\n    <p>The statutory provisions on impossibility, irregularities of performance and force majeure remain unaffected.<\/p>\n\n    <h2 id=\"wlan\">17. Wi-Fi &amp; internet<\/h2>\n    <p>Where internet access is provided in the accommodation, it is an additional service to the accommodation.<\/p>\n    <p>A specific transmission speed or uninterrupted availability is only owed if expressly promised.<\/p>\n    <p>The guest may not use the internet access for unlawful purposes.<\/p>\n    <p>The guest is responsible in accordance with the statutory provisions for actions carried out via their access or devices.<\/p>\n\n    <h2 id=\"parkplatz\">18. Parking<\/h2>\n    <p>Where a parking space is offered with an accommodation, there is only an entitlement to it to the extent set out in the respective property description or booking confirmation.<\/p>\n    <p>Use is subject to local conditions and the parking rules in force.<\/p>\n    <p>The statutory liability provisions apply to damage to or loss of vehicles.<\/p>\n\n    <h2 id=\"meldung\">19. Guest registration &amp; legal obligations<\/h2>\n    <p>The guest is obliged to provide the information required to fulfil statutory registration and tax obligations.<\/p>\n    <p>Where digital guest registration is provided for the respective accommodation, the guest may receive a link to an external guest registration system, for example Feratel.<\/p>\n    <p>The guest is obliged to provide the required registration data completely and correctly.<\/p>\n    <p>Statutory local taxes, guest taxes or comparable levies must be paid by the guest unless they are already expressly included in the total price.<\/p>\n\n    <h2 id=\"haftung\">20. Liability<\/h2>\n    <p>L\u00e4ndlefee is liable in accordance with the statutory provisions.<\/p>\n    <p>Liability for slight negligence towards consumers is only excluded to the extent permitted by law and where no injury to life, body or health and no essential contractual obligations are concerned.<\/p>\n    <p>The statutory liability provisions apply to the guest's personal belongings.<\/p>\n    <p>For services of independent third-party providers that are not part of the contract concluded with L\u00e4ndlefee, the respective third-party provider is itself liable.<\/p>\n\n    <h2 id=\"kommunikation\">21. Communication<\/h2>\n    <p>Communication with the guest may take place in particular by email and via the booking system used for the booking or the respective booking platform.<\/p>\n    <p>The guest is responsible for providing a correct and reachable email address and up-to-date contact details.<\/p>\n    <p>Booking-related notifications may be sent to the email address most recently provided by the guest.<\/p>\n\n    <h2 id=\"datenschutz\">22. Data protection<\/h2>\n    <p>Information on the processing of personal data can be found in L\u00e4ndlefee's current privacy policy at:<\/p>\n    <p><a href=\"https:\/\/laendlefee.com\/en\/datenschutz\/\" target=\"_blank\" rel=\"noopener\">www.laendlefee.com\/datenschutz\/<\/a><\/p>\n    <p>Webplanner and Stripe in particular may be used for booking and payment processes.<\/p>\n    <p>Depending on the accommodation, external systems such as Feratel may be used for statutory guest registration.<\/p>\n\n    <h2 id=\"recht\">23. Applicable law<\/h2>\n    <p>Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.<\/p>\n    <p>For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state of their habitual residence.<\/p>\n\n    <h2 id=\"gericht\">24. Place of jurisdiction<\/h2>\n    <p>For consumers, the statutory rules on jurisdiction apply.<\/p>\n    <p>For contracts with businesses, the competent court at the registered office of Andrea Keri e.U. is agreed, to the extent permitted by law.<\/p>\n\n    <h2 id=\"schluss\">25. Final provisions<\/h2>\n    <p>Should individual provisions of these Terms be or become invalid or unenforceable, the remaining provisions shall remain unaffected to the extent permitted by law.<\/p>\n    <p>Invalid provisions shall be replaced by the statutory provisions.<\/p>\n    <p>The Terms valid at the time the contract is concluded and the individually agreed conditions of the respective booking are decisive for the booking.
