General Terms and Conditions for Service Packages
These terms apply to consulting, organisation and support services provided by Ländlefee in connection with holiday apartments and holiday homes. They apply to both business customers and, where applicable, consumers. This English translation is provided for convenience only; the German version is legally binding.
1. Scope
These General Terms and Conditions apply to contracts for service, consulting, organisation and support services provided by Ländlefee – Andrea Keri e.U. (hereinafter “Ländlefee”) in connection with the rental, presentation, organisation and marketing of holiday apartments and holiday homes.
They apply in particular to the service packages offered on the website, including Startklar-Check, Buchungsfit, Komplett-Setup, Direktbuchungs-Paket, Gästeservice-Setup and Digitale Gästemappe.
Separate terms apply to the rental of holiday accommodation to guests. These terms relate exclusively to the services described here.
2. Businesses and consumers
A customer may be either a business or a consumer.
A business is anyone who concludes the contract in the course of operating their business. A consumer is anyone who does not conclude the contract for a business activity.
Being the owner or landlord of a holiday property does not in itself mean that a customer is considered a business in the specific contractual relationship.
Where the website or the ordering process asks whether the customer is a business or a consumer, the customer must answer truthfully.
Provisions of these terms that expressly concern consumers only do not apply to contracts with businesses. Mandatory statutory consumer rights remain unaffected.
3. Contracting party
The contracting party is Ländlefee – Andrea Keri e.U., Herrenfeld 43, 6972 Fußach, Austria.
Ländlefee provides services relating to the preparation, organisation, optimisation and marketing of holiday properties.
4. Scope of services
The specific scope of services is set out in the description of the respective service package published on the website at the time of ordering, or in an individually prepared quote.
Depending on the package booked, the following services in particular may be included:
- Analysis and optimisation of existing holiday accommodation and booking listings
- Pricing and seasonal structure
- Optimisation of listings and accommodation descriptions
- Support with Booking.com, Airbnb and other booking platforms
- Optimisation of direct booking options
- Development and optimisation of guest communication
- Check-in and check-out processes
- Design of digital guest information and guest guides
- Advice on furnishings, presentation and booking conditions
- structured recommendations, action lists and coordination meetings
Services not expressly listed in the respective package are not part of the agreed scope of services and may be offered and charged separately.
Technical implementation on websites, booking systems, channel managers or other third-party systems is only included if expressly agreed.
5. No guarantee of success or bookings
Ländlefee provides the agreed services with due care and on the basis of the information available at the time the services are provided.
No particular economic success is owed. In particular, there is no guarantee of a certain number of bookings, a certain occupancy rate, certain nightly rates, revenues or rankings on booking platforms.
Decisions and changes by booking platforms, search engines and other third-party providers are beyond Ländlefee’s control.
6. Conclusion of contract for directly bookable service packages
For directly bookable service packages, the main characteristics of the service and the total price are displayed before the order is completed.
By clicking the order or payment button clearly marked as involving an obligation to pay, the customer places a binding order. Payment is processed via the payment service provider indicated in the ordering process.
The contract is concluded when Ländlefee accepts the order or confirms the conclusion of the contract accordingly.
7. Conclusion of contract for services on request
For services marked “Paket anfragen”, “Projekt anfragen”, “Angebot anfragen” (request package / project / quote) or similar, the enquiry does not yet constitute a contract subject to charges.
The contract is only concluded upon acceptance of an individual quote or another clear agreement between Ländlefee and the customer.
8. Prices and payment
The prices applicable at the time of ordering or those stated in the individual quote apply.
Where prices on the website are shown as final prices, they include statutory VAT. For businesses, VAT may be shown separately on the invoice.
For directly bookable service packages, payment is generally made immediately upon ordering via the payment service provider offered. For individually quoted services, the payment terms stated in the respective quote or invoice apply.
9. Customer’s duty to cooperate
The customer provides all information, documents, images, texts, access data and other content required for the agreed service.
The customer is responsible for ensuring that the information provided is complete and correct and that they are entitled to use or pass on the content and access provided.
Delays due to missing, late or incomplete cooperation extend agreed processing times accordingly.
10. Processing and start of services
Processing begins once the contract has been concluded, payment has been received in full and the information and documents required for performance are available.
For businesses, the service may begin immediately once these conditions are met, unless otherwise agreed.
For consumers, Ländlefee only begins providing the service before the end of a statutory withdrawal period if the consumer has expressly requested this. The declarations required by law for this are obtained separately in the ordering process.
11. Right of withdrawal for consumers
This section applies exclusively to customers who conclude the contract as consumers within the meaning of consumer protection law.
For a service contract concluded at a distance, there is generally a statutory right of withdrawal of 14 days from conclusion of the contract, unless a statutory exception applies.
Details of the conditions, deadlines, exercise and consequences of the right of withdrawal are set out in the separate withdrawal information for service packages, including the model withdrawal form.
If a consumer expressly requests that Ländlefee begins the service during the withdrawal period, the statutory rules on proportionate compensation for services already provided may apply in the event of a later withdrawal.
Where the service has been provided in full, the right of withdrawal can only expire under the conditions provided for by law.
Businesses have no statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG). A voluntary right of withdrawal or cancellation only exists if expressly agreed.
12. Changes and additional services
Services or changes that go beyond the agreed package scope may be offered and charged separately.
Ländlefee informs the customer of any additional costs before carrying out chargeable additional services.
13. Third-party services and systems
Where external platforms, software providers, payment service providers, booking systems, channel managers, website systems or other third-party services are used, their respective terms also apply.
Ländlefee has no influence on the continued availability, pricing, functionality, policies or technical changes of such third-party providers.
Third-party costs are only included in the price of a service package if expressly stated.
14. Content and rights provided by the customer
The customer confirms that they hold the necessary rights to the texts, images, logos, trademarks, data and other content provided.
The customer grants Ländlefee the rights of use required for the duration and purpose of fulfilling the order.
15. Liability
Ländlefee is liable in accordance with the statutory provisions.
To the extent permitted by law, Ländlefee is not liable for circumstances beyond its control, in particular for changes, suspensions, outages or decisions of booking platforms, payment service providers, hosting providers, website systems or other third-party providers.
Mandatory statutory liability provisions, in particular towards consumers, remain unaffected.
16. Warranty
The statutory warranty provisions apply. Mandatory statutory warranty rights of consumers are not restricted by these terms.
17. Data protection
Personal data is processed in accordance with applicable data protection law. Further information can be found in the privacy policy on laendlefee.com.
18. Communication
Communication in connection with an order may take place in particular by email. The customer is responsible for providing a correct and reachable email address and for notifying any changes to their contact details.
19. Applicable law
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the country in which the consumer has their habitual residence.
20. Place of jurisdiction
For businesses, to the extent permitted by law, the court with subject-matter jurisdiction at Ländlefee’s registered office is agreed as the place of jurisdiction.
For consumers, the statutory provisions on jurisdiction apply.
21. Final provisions
Should individual provisions of these terms be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions, to the extent permitted by law.
Mandatory statutory consumer rights remain unaffected in all cases.
